BUYER: The natural or legal person whose information is obtained during the order (the "Buyer"). The Buyer's information is set out in the order summary.
Subject Matter
The subject matter of this agreement is the determination of the rights and obligations of the parties, pursuant to the provisions of the Turkish Law No. 6502 on the Protection of Consumers (6502 sayılı Tüketicinin Korunması Hakkında Kanun) and the Regulation on Distance Contracts (Mesafeli Sözleşmeler Yönetmeliği), with respect to the characteristics, fee and use of the OptiMor cloud software service for which the Buyer has started a subscription electronically via optimor.io, which belongs to the Seller.
Characteristics of the Service and Fee
The Service is a digital software service provided according to the selected plan (Text AiMor, Voice AiMor, Complete AiMor or the trial plan) and the message/minute quota. The plan contents and current fees are displayed on the pricing page and in the order summary at the time of the order. Fees are VAT inclusive.
Performance of the Service
The Service is provided digitally; when the subscription is started, account access is opened and performance commences immediately. There is no physical delivery.
Right of Withdrawal
If the Buyer qualifies as a consumer, the Buyer has the right to withdraw within 14 days from the date on which the agreement was concluded, without giving any reason. However, pursuant to Article 15 of the Regulation on Distance Contracts (Mesafeli Sözleşmeler Yönetmeliği m.15), the right of withdrawal cannot be exercised in agreements relating to services whose performance has begun with the Buyer's approval before the withdrawal period has expired. By approving the immediate commencement of the subscription, the Buyer accepts this situation.
Subscription, Renewal and Cancellation
The subscription is renewed according to the selected period. The Buyer may cancel the subscription through the panel, with effect from the end of the period.
Free Trial
The trial plan is offered without credit card information being collected; no automatic charge is made at the end of the trial. The scope and limits of the trial are stated at the time of the order.
Dispute Resolution
In disputes, the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) at the Buyer's place of residence are competent within the monetary limits announced by the Ministry of Trade (Ticaret Bakanlığı), and the Consumer Courts (Tüketici Mahkemeleri) are competent in cases exceeding those limits. For buyers who do not qualify as consumers, the courts and enforcement offices of Istanbul have jurisdiction.
Entry into Force
The agreement is deemed to have been concluded when the Buyer reads and approves this agreement and the preliminary information electronically. The text of the agreement is stored by the Seller and is delivered to the Buyer upon request.
