Data Controller

Pursuant to the Turkish Law No. 6698 on the Protection of Personal Data (6698 sayılı Kişisel Verilerin Korunması Kanunu, the "KVKK"), your personal data is processed by OptiMor ("OptiMor" or the "Company"), in its capacity as data controller, within the scope explained below.

Personal Data Processed

Within the scope of your visit to our website, your demo request, your creation of an account or your use of our services, the following categories of data may be processed:

·Identity data: first name, last name·Contact data: e-mail address, telephone number, company name·Customer transaction data: request and meeting records, subscription and invoicing information·Transaction security data: IP address, session and log records, device/browser information·Marketing data: usage data obtained through cookies (only with your explicit consent)

With respect to the data belonging to the end users of our customers who use the platform, the Company acts in the capacity of "data processor" under the KVKK; the data controller for such data is the relevant customer.

Purposes of Processing

·Providing the services, creating and managing the account·Responding to demo and support requests and communicating with you·Fulfilling contractual and legal obligations, and invoicing·Ensuring the security of the service and preventing misuse·Where your explicit consent exists, sending commercial electronic messages and performing analytical measurement

Legal Grounds

Your personal data is processed on the legal grounds set out in KVKK m.5/2 (Article 5/2 of the KVKK), namely that processing is necessary for the conclusion or performance of a contract, for the fulfilment of a legal obligation, for legitimate interests, and for the establishment, exercise or protection of a right; in cases falling outside these grounds (for example marketing messages and analytics cookies), it is processed on the basis of your explicit consent pursuant to KVKK m.5/1 (Article 5/1 of the KVKK).

Transfers

Your personal data may be transferred to our hosting, e-mail, payment and similar service providers, solely to the extent required by the service and under contractual safeguards; and to authorised public authorities within the scope of legal obligations. The data is hosted in Türkiye.

Method of Collection

Your data is collected electronically through website forms, registration and login screens, cookies, e-mail and telephone communication, and during your use of the platform.

Retention Period

Your personal data is retained for the period required by the purpose of processing and for the statute of limitation periods prescribed in the relevant legislation; at the end of those periods it is erased, destroyed or anonymised.

Your Rights Under KVKK m.11 (Article 11 of the KVKK)

You have the right to learn whether your personal data is being processed; to request information if it has been processed; to learn whether it is used in accordance with its purpose; to know the third parties to whom it has been transferred; to request its rectification if it has been processed incompletely or inaccurately; to request its erasure or destruction; to request that these operations be notified to the third parties to whom the data has been transferred; to object to an adverse result arising against you from analysis carried out exclusively by automated systems; and to demand compensation for the damage in the event that you suffer damage due to unlawful processing.

Method of Application

You may submit your applications in writing to [email protected]. Applications are concluded free of charge within 30 days at the latest; where the process additionally requires a cost, the fee set out in the tariff of the Personal Data Protection Board (Kişisel Verileri Koruma Kurulu) may be charged.
